Definitions

• User / Customer – Any individual accessing FunkySouq to browse, purchase, or interact with products.
• Vendor / Seller – Any legal entity or individual registered with FunkySouq to sell products.
• Platform – FunkySouq's website, app, and related digital services.
• Products – Goods listed for sale through FunkySouq.
• Services – Includes order placement, payment processing, delivery, Try-On, and promotions.

Eligibility

• Users must be 18 years or older to register or purchase on FunkySouq.
• Vendors must hold a valid trade license (UAE or foreign equivalent) and provide all compliance documents.
• FunkySouq reserves the right to reject, suspend, or terminate accounts without prior notice if eligibility is not met.

Account Registration

• Users and Vendors must provide accurate, complete, and updated information.
• Login credentials must be kept confidential.
• FunkySouq is not liable for losses arising from unauthorized account access due to user negligence.

Products & Listings

• Product descriptions, images, and specifications are provided by Vendors or FunkySouq.
• Virtual Try-On images are for representation only and may not perfectly match real-world fit or color.
• FunkySouq does not guarantee the accuracy of third-party product information.

Orders & Payments

• All orders are subject to acceptance and availability.
• Payments are processed securely through Network International.
• FunkySouq does not store card details.
• In case of payment failure, the order will not be processed.

Pricing & Taxes

• Prices are displayed in AED (United Arab Emirates Dirhams) unless otherwise stated.
• VAT (where applicable) is included or added as per UAE law.
• Prices may change without notice but will not affect confirmed orders.

Delivery & Shipping

• Orders are delivered via FunkySouq logistics partners.
• Estimated delivery times are displayed at checkout but may vary.
• FunkySouq is not liable for delays caused by logistics providers, customs, or unforeseen events.

Returns & Refunds

• Customers may return eligible products within 7 days of delivery.
• Products must be unused, undamaged, and in original packaging.
• Refunds are processed within 7 working days after quality check.
• Certain items (e.g., innerwear, cosmetics, clearance items) are non-returnable for hygiene/safety reasons.
• Refunds will be credited back to the original payment method only.

User-Generated Content & Try-On Feature

• Users may upload images for Virtual Try-On.
• By uploading, users grant FunkySouq a limited license to process and display such images.
• FunkySouq will not sell, share, or misuse uploaded images.
• Users may request deletion of their Try-On images at any time.

Vendor Terms

• Vendors agree to FunkySouq's Financial & Onboarding Agreement.
• Vendors are responsible for:
  • Authenticity and quality of products
  • Compliance with UAE consumer protection laws
  • Updating stock availability and pricing
• FunkySouq may suspend or delist Vendors for non-compliance.

Marketing & Promotions

• FunkySouq may run promotions, discounts, and advertising campaigns.
• Vendors may opt-in for paid promotions (sponsored, featured, banner ads, influencer campaigns, etc.).
• Marketing fees are non-refundable once campaigns are live.

Prohibited Activities

Users and Vendors are strictly prohibited from:

• Selling counterfeit or restricted goods
• Misusing Try-On images or FunkySouq's intellectual property
• Providing false information or fraudulent transactions
• Attempting to hack, disrupt, or manipulate the platform

Violation may result in suspension, blacklisting, and legal action under UAE cybercrime and AML laws.

Intellectual Property

• All platform content (logos, designs, text, images, software) is owned by FunkySouq.
• Unauthorized use, reproduction, or distribution is prohibited.

Limitation of Liability

• FunkySouq provides the platform on an "as is" and "as available" basis.
• We are not liable for indirect, incidental, or consequential damages.
• Maximum liability is limited to the order value of the disputed transaction.

Data Protection & Privacy

• FunkySouq complies with UAE data protection regulations, TRA rules, and GDPR (where applicable).
• Details are outlined in our Privacy Policy.

Suspension & Termination

• FunkySouq reserves the right to suspend accounts for policy violations, fraud, or legal issues.
• Vendors and Users may terminate their accounts with written notice, subject to settlement of dues.

Force Majeure

FunkySouq shall not be liable for failure to perform obligations due to events beyond reasonable control (natural disasters, government actions, internet outages, etc.).

Governing Law & Jurisdiction

• These Terms are governed by UAE Federal Law.
• Disputes shall be subject to the exclusive jurisdiction of Dubai Courts.

Amendments

• FunkySouq reserves the right to amend these Terms at any time.
• Users and Vendors will be notified of material changes.
• Continued use after changes constitutes acceptance.
